Gopher State One-Call (“GSOC” or “we”,“our”, or “us”) respects your privacy and is committed to being transparent about how we collect and use information about you. This Privacy Policy (“Privacy Policy”) describes the types of information we may collect from you or that you may provide to us, and our practices for collecting, using, maintaining, and disclosing that information. This information may be collected through our website at http://www.gopherstateonecall.org (together with any related websites maintained by us, the “Site”), as well as through social media, our marketing activities, our live events and the other sources and activities described in this Privacy Policy.

GSOC may provide additional or supplemental privacy policies to individuals for specific services that we offer or for other purposes at the time we collect personal information.

By browsing, accessing, using or interacting with the features of the Site, you are agreeing to the collection, use, and disclosure of your personal information as described in this Privacy Policy. If you do not agree to the terms of this Privacy Policy, you should immediately exit and stop using the Site. By accessing or using the Site, you agree to this Privacy Policy. Please read these terms carefully before using the Site.

Intended Audience

The Site is intended for, offered and made available only to users who are 13 years of age or older. By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you may not access or use the Site. We do not intentionally collect personal information from persons younger than the age of 13. If you are the parent or legal guardian of a child age 13 years or younger and believe that we have inadvertently collected personal information from your child, please contact us by using the information below.

Personal Information We Collect

When you visit our Site, create an account with us, or communicate with us, we may collect certain information about you, which may be personal information. “Personal Information” includes information that is reasonably capable of being associated with, or could reasonably be linked to, a particular consumer or household. This section describes the types of Personal Information we may collect about you, and the ways in which we may collect such information.

Information you voluntarily provide to us. You may, at times, intentionally provide us with the following:

  • Contact information, such as your first and last name, email address, mailing address, professional title and company name, and phone number.
  • Account data, such as the username and password that you may use for secured sections of the Site, and any other information that you add to your account profile as a user.
  • Communications data, including when you contact us through the Site, e-mail, social media, or otherwise.
  • Marketing data, such as your preferences for receiving our e-mail communications and details about your engagement with them.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.
  • Transactional data, such as information relating to shipment requests on or through the Site, including order numbers and transaction history.

We do not collect, and ask that you not provide us with, any sensitive data, such as data that reveals the race, ethnic origin, religious beliefs, mental or physical health conditions or diagnoses, sexual preferences or orientation, or citizenship status or citizenship of an individual.

Third-party sources. We may combine Personal Information we receive from you with information we obtain from public sources, such as government agencies, public records, social media platforms, and other publicly available sources.

Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Site, our communications, and other online services, as follows:

  • Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.

  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Site, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.

Tracking technologies. Some of the automatic collection described above is facilitated by the following technologies:

  • Cookies, which are small text files that websites store on user devices and that allow web servers to record users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on our sites may include both “session cookies” that are deleted when a session ends, “persistent cookies” that remain longer, “first party” cookies that we place and “third party” cookies that our third-party business partners and service providers place.

    Cookies do not contain any information that personally identifies you, but Personal Information that we store about you may be linked, by us or our services providers, to the information stored in and obtained from cookies. You may remove the cookies by following the instructions of your device preferences; however, if you choose to disable cookies, some features of the Site may not operate properly and your online experience may be limited.• Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.

  • Web beacons, also known as pixel tags, single-pixel gifs, or clear gifs, are small electronic files which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked. Certain sections of our Site and our emails may contain web beacons that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (e.g., recording the popularity of a blog post, and assessing the effectiveness of our industry outreach efforts, etc.). We use these primarily to assist in determining the efficacy of our marketing and education initiatives.

How We Use Your Personal Information

We may use your Personal Information for the following purposes or as otherwise described at the time of collection:

General Business Operations. We may use your Personal Information to:

  • operate our business as Minnesota’s exclusive underground excavation notification center;
  • provide, operate and improve our business generally, such as to send confirmations, reach out to you on matters related to underground damage prevention, and answer your questions regarding the same;
  • establish and maintain your user profile on the Site, if any;
  • communicate with you about GSOC and the Site, including by sending announcements, updates, security alerts, and support and administrative messages related to the Site;
  • understand your needs and interests, and personalize your experience with the Site and our communications; and
  • provide support for the Site and respond to your requests, questions and feedback.

Industry Outreach. We, our service providers, and our third-party advertising partners may collect and use your Personal Information for marketing and advertising purposes that are tied to our mission as Minnesota’s exclusive underground excavation notification center:

  • Direct outreach. We may send you direct communications, which are generally intended to provide you with information related to the underground damage prevention industry, excavations, underground locate services, and related businesses and industries. These communications may include information on regulatory updates, upcoming events, compliance reminders, and related educational materials.

  • Interest-based advertising. Our third-party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) with the Site, our communications and other online services over time, and use that information to serve online ads that they think will interest you or are important for you work in the excavation, utility, facility location, or related industries. This is called “interest-based advertising”. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms.

Notification Center Operations. As discussed on the Site, we provide many of our services by contracting with One Call Concepts, Inc. (“OCC”). In particular, OCC operates GSOC’s call center and internet-based ticket services (the “ITIC” system). Your use of ITIC and OCC’s other software solutions to provide us with digital or electronic tickets is, therefore, subject to your acceptance of the terms and conditions of those programs, as published by OCC, including its privacy policies.

Because the Site, and ITIC, are intended for excavators and homeowners to submit notices of excavation within the State of Minnesota, please be aware that we or OCC will forward these notices to public and private sector “Facility Operators” that have indicated a desire to be notified of an excavation in the identified area, and these notices may include your name, address and other contact information.

We may also share your personal information if we believe in our sole discretion that disclosure is necessary to protect the rights, property, or safety of GSOC, OCC, our customers, homeowners, excavators, public and private sector Facility Operators, or others, including the general public.

Automated Redaction of Certain Ticket Information. State law requires excavators in Minnesota to provide GSOC with certain personal information (including contact information) in order for GSOC to communicate this information to affected underground facility operators. Although a ticket has a 14-day life, GSOC has determined it is appropriate for all ticket data to be accessible via OCC’s “Search and Status” system for 30 days after submission of the data to GSOC. After the 30-day period has expired, certain personal identifier data is automatically removed from Search and Status and the ISITE ticket search tool. After one year from the time of submission (365 days), a ticket is removed from Search and Status and the ISITE ticket search tool altogether.

Please Note, however, that Minnesota law requires GSOC to maintain all ticket information (including your personal information contained in a ticket) for 6 years.

Compliance and protection. We may use your Personal Information to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • audit our internal processes for compliance with legal and contractual requirements or our internal policies;
  • enforce the terms and conditions that govern the Site; and
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

With your consent. In some cases, we may specifically ask for your consent to collect, use or share your Personal Information, such as when required by law.

For Analytics Purposes. To help us understand user activity on the Site, we may use services such as Google Analytics to learn more about the types of users that visit the Site, how they use the Site, and to help us improve our services and outreach efforts. These services may provide us with certain data regarding the demographics of the users that visit the Site. To do so, the service may collect certain information about you from your computer using cookies, including information described in the online activity data section above.

Retention. We generally retain Personal Information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for Personal Information, we may consider factors such as the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

How We Share Your Personal Information

We may share Personal Information we collect about you with third parties and as otherwise described in this Privacy Policy. Please note that this Privacy Policy only governs GSOC’s use of your Personal Information -- not the use of any information by any other party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use. See the links below of the third parties we may work with to provide the Services for more information.

Service providers. Third parties that provide services on our behalf or help us operate the Site and provide services.

Advertising partners. Third-party advertising companies for the interest-based advertising purposes described above.

Professional advisors. Professional advisors, such as lawyers, auditors, compliance professionals, bankers and insurers, where necessary in the course of the professional services that they render to us to enable us to operate our business and provide services to you.

Authorities and others. Law enforcement, state regulators, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

Your Rights for Personal Information We Collect

For the Personal Information we collect about you, you have the following choices with respect to such personal information.

Correct Data. You may correct inaccurate Personal Information by contacting us.

Opt-out. You may opt out of the sale or sharing of your information, including targeted advertising, by contacting us. Additionally, at any time you may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email you received from us or our marketing vendor, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive Service-related and other non-marketing emails.

Non-discrimination. You have the right not to be discriminated against for exercising any of your rights granted under this privacy policy and applicable privacy laws.

Mobile location data. You can disable our access to your device’s precise geolocation in your mobile device settings.

Advertising choices. You may opt-out of use of your information by third parties as instructed in their privacy policies, and through the following settings/options/tools:

  • Browser settings. Changing your internet web browser settings to block third-party cookies.
  • Privacy browsers/plug-ins. Using privacy browsers and/or ad-blocking browser plug-ins that let you block tracking technologies.
  • Platform settings. Google and Facebook offer opt-out features that let you opt-out of use of your information for interest-based advertising.
  • Mobile settings. Using your mobile device settings to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.

You will need to apply these opt-out settings on each device and browser from which you wish to limit the use of your information for interest-based advertising purposes. We cannot offer any assurances as to whether the companies we work with participate in the opt-out programs described above.

Other Sites and Services

The Site may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.

Security

We employ a number of technical, organizational, administrative, and physical safeguards designed to protect the Personal Information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your Personal Information.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Site or other appropriate means. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Site after the effective date of any modified Privacy Policy indicates your acknowledgment that the modified Privacy Policy applies to your interactions with the Site and our business.
